You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify BuySell immediately of any unauthorized use of your account.
Users are solely responsible for the accuracy, completeness, and legality of all information included in their listings, including but not limited to: - Equipment descriptions - Specifications - Condition reports - Pricing - Photographs - Contact information
You agree not to post any content that: - Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, or invasive of privacy - Infringes upon any intellectual property or other rights of any party - Contains viruses, trojan horses, worms, time bombs, or other harmful programming - Constitutes spam, pyramid schemes, or unsolicited advertising - Violates any applicable laws or regulations
BuySell reserves the right, at its sole discretion, to remove or refuse any listing that violates these Terms or is otherwise objectionable, without prior notice or liability.
BuySell does not: - Verify the identity of users - Verify the accuracy or completeness of listings - Verify the existence, condition, ownership, or value of equipment listed - Verify the ability of buyers to pay or sellers to deliver - Guarantee that users will complete transactions
BuySell: - Does not facilitate, process, or guarantee payments - Does not provide escrow services - Does not authenticate or inspect equipment - Does not arrange or guarantee delivery or shipping - Does not mediate disputes between users - Does not take possession of equipment at any point
You acknowledge and agree that: - All transactions occur entirely at your own risk - You are solely responsible for conducting due diligence on any potential transaction partner - You are solely responsible for verifying equipment condition, authenticity, and value - You are solely responsible for arranging safe payment and delivery methods - BuySell shall not be liable for any losses, damages, or injuries resulting from transactions facilitated through the platform
As a condition of using BuySell, you agree to: - Comply with all applicable local, state, national, and international laws and regulations - Use the platform only for lawful purposes - Not impersonate any person or entity or misrepresent your affiliation with any person or entity - Not interfere with or disrupt the operation of the platform - Not collect or harvest personal data about other users without their consent - Not attempt to gain unauthorized access to any portion of the platform
All content on the BuySell website, including text, graphics, logos, images, and software, is the property of Primes & Zooms or its licensors and is protected by copyright and trademark laws.
By posting content to BuySell, you grant Primes & Zooms a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content solely in connection with the operation and promotion of the BuySell platform.
BuySell respects the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us with the required information.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: - BUYSELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY - BUYSELL SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM USE OF OR INABILITY TO USE THE PLATFORM - BUYSELL'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO BUYSELL IN THE SIX (6) MONTHS PRECEDING THE CLAIM (IF ANY) - BUYSELL SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND ITS REASONABLE CONTROL
THE FOREGOING LIMITATIONS APPLY WHETHER THE LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF BUYSELL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend, and hold harmless Primes & Zooms, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with: - Your access to or use of BuySell - Your violation of any term of these Terms - Your violation of any third-party right, including any intellectual property or publicity right - Any listing or content you post on BuySell - Your interaction with other users of the platform
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Pune, Maharashtra, India, and you hereby consent to and submit to the personal jurisdiction of such courts for the purpose of litigating any such action or proceeding.
BuySell reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 day's notice prior to the effective date of any changes. What constitutes a material change will be determined at our sole discretion. By continuing to access or use BuySell after any revisions become effective, you agree to be bound by the revised Terms.
BuySell may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the platform will cease immediately.
Any dispute arising out of or relating to these Terms or the use of BuySell shall be resolved through binding arbitration in Pune, Maharashtra, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitrator's decision shall be final and binding on both parties.
These Terms, together with any other policies or guidelines referenced herein, constitute the entire agreement between you and BuySell regarding your use of the platform, and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.
